1. Introduction

This Data Processing Addendum (“Addendum”) forms part of the service agreement between DrClear House Clearance (“the Processor”) and the Client (“the Controller”) when personal data is processed on behalf of the Client.

This Addendum ensures both parties comply with their respective obligations under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.


2. Parties

Data Controller: The business or organisation engaging DrClear House Clearance to provide clearance services involving personal data (e.g., property owners, estate agents, solicitors, councils).
Data Processor: DrClear House Clearance, owned and operated by Krzysztof Szczesny (Chris), 5 Churchfields Rd, Wednesbury, WS10 9DX.


3. Purpose of Processing

DrClear House Clearance may process limited personal data on behalf of the Client solely to perform agreed property clearance services.
Examples include:

  • Contact names, addresses, phone numbers, and emails.

  • Property addresses and access instructions.

  • Documentation relating to property ownership, probate, or tenancy.


4. Nature of Processing

Processing is limited to:

  • Receiving, storing, and using data to arrange and perform the contracted clearance service.

  • Transmitting information as necessary to subcontractors (e.g., disposal facilities) under strict confidentiality.

  • Securely deleting or returning data once services are completed.

No other processing will be undertaken without the Client’s documented instructions.


5. Duration of Processing

Processing continues only for the duration of the contract.
Personal data will be securely deleted or returned to the Client within 30 days after completion, unless required for legal or insurance purposes.


6. Data Protection Obligations of DrClear House Clearance

DrClear House Clearance agrees to:

  1. Act only on written instructions from the Client.

  2. Ensure confidentiality — all staff handling data are bound by confidentiality obligations.

  3. Implement appropriate technical and organisational measures to ensure data security, including:

    • Encrypted storage and secure devices

    • Limited access to authorised personnel

    • Secure email and communication practices

  4. Assist the Controller with data subject rights requests, data breaches, or regulatory enquiries.

  5. Notify the Controller without undue delay (within 48 hours) of any personal data breach.

  6. Maintain records of processing activities where required by UK GDPR.

  7. Cooperate fully with the Information Commissioner’s Office (ICO) if required.


7. Subprocessors

DrClear House Clearance may use trusted subprocessors (e.g., waste transfer partners or IT providers) for specific operations.
All subprocessors are bound by written contracts that impose equivalent data protection obligations.
A list of subprocessors is available upon request.


8. Data Subject Rights

Where feasible, DrClear House Clearance will assist the Controller in fulfilling obligations to respond to data subject requests (e.g., access, rectification, erasure, restriction, or portability).


9. Transfers of Data

DrClear House Clearance does not transfer personal data outside the UK.
If international transfers become necessary, appropriate safeguards under UK GDPR (such as Standard Contractual Clauses) will be applied.


10. Termination and Data Return

Upon termination of the agreement or completion of services, all personal data will be securely deleted or returned to the Client within 30 days, unless retention is required by law.


11. Liability and Indemnity

Each party shall be liable for its own acts and omissions under this Addendum.
DrClear House Clearance’s liability is limited to the direct costs of remedial actions required by UK GDPR compliance, except in cases of wilful misconduct or gross negligence.


12. Governing Law and Jurisdiction

This Addendum is governed by the laws of England and Wales, and any disputes shall be resolved in the courts of England and Wales.
